Yesterday, the Supreme Court ruled that the government cannot proceed with the new rule it sought to implement through the Postal Service to restrict voting by mail. Alianza Americas, a network of migrant-led organizations from Latin America and the Caribbean living in the United States, welcomes the Supreme Court's decision with relief, as it protects the right to vote against the Trump administration’s attempts to restrict it.
Since first running for president, Donald Trump has sought to undermine public confidence in the integrity of the U.S. electoral process. The country continues to confront the consequences of false claims about the 2020 presidential election, which culminated in the violent attack on the Capitol on January 6, 2021, during the certification of the presidential election. Furthermore, despite the false narrative disseminated by the government—which insists that election fraud exists, particularly in mail-in voting, and that foreigners are voting without being eligible to do so—the evidence shows the exact opposite. No justification exists for imposing additional controls or requirements on the electoral process; instead, such requirements would harm voter turnout, an unequivocal indicator of the strength of the democratic system.
Recently, on August 26, the Postal Service enacted a rule that imposes requirements on voting by mail and assigns itself a role in the electoral process. The rule raises concerns about the ability to exercise the right to vote by mail, which is critical for people living in remote areas—who cannot be present at the location where they are registered to vote—as well as for older adults and those with limited mobility. The Supreme Court has ruled that the rule cannot be applied to the November 6 election. The substantive litigation in the case, regarding the Postal Service's role, will continue
The judicial branch has fulfilled its responsibility to defend voting rights and protect our democracy. Now, active civic participation is critical to upholding the integrity and trust in the electoral process. It is now up to all stakeholders in the electoral process to fulfill their roles to ensure a fair and transparent process, one that upholds the constitutional right of all U.S. citizens to exercise their right to vote, to elect, and to be elected.
