Alianza Americas welcomes with relief the decision by the majority of the U.S. Supreme Court regarding President Trump’s failed attempt to restrict birthright citizenship. We reaffirm our commitment to continue defending this right against the xenophobic and white supremacist attacks by this administration, which disregard the country’s history and run counter to the values of the American people.
Once again, the Court reached a split decision (5-4) based on historical interpretations that are reflected in the majority opinion, the concurring opinion, and the dissenting opinions. The Supreme Court majority rejected the president’s attempts to rewrite the Fourteenth Amendment to the Constitution by seeking, through an executive order, to add a domicile requirement and to determine that those without permanent residence do not have domicile in the country.
The Fourteenth Amendment was defended by recognizing its historical significance in defining who an American is and rejecting any attempt to rewrite it through an abuse of executive power. The myths surrounding the entry of pregnant women into the country—or the idea that migrants have children solely for immigration purposes—deny the humanity of those who are forced to migrate. The administration’s attempt to violate the Constitution through its reinterpretation was nothing more than an effort to define who belongs, who is welcomed, and who is denied the opportunity to fully call this country home.
We will respond decisively to any new attempts to reform nationality laws in ways that restrict rights or exclude people from the protections they guarantee. The history of the United States does not belong solely to those who signed the Declaration of Independence 250 years ago and their descendants. It also belongs to those who, generation after generation, have worked to bring the country closer to the promise of a more inclusive democracy—one that guarantees everyone the opportunity to achieve life, liberty, and happiness.
