What do the latest DACA decisions mean?

DACA’s future is uncertain. On October 5, 2022, an appeals court upheld a ruling by a Texas judge: that DACA is illegal. However, the program will continue for now — this was upheld by an October 14 decision by that same Texas judge, who ruled that DACA can remain in place, but with limitations (for example, no new applicants).

How does this impact DACA recipients and DACA eligible youth?

  • If you have DACA at this time, you are still protected and will be able to continue renewing for now.
  • Advance parole, which allows DACA recipients to travel, will remain open for now.
  • If your first-time DACA application has not been granted as of July 16, 2021, DHS will not process your request, but DHS continues to receive new applications.

Congress must take action!

DACA is under threat and unless President Biden and Congress take action this year, it’s very likely that DACA will end. Congress must ACT NOW and pass legislation that permanently protects all immigrant youth, our families, and our communities.
