Supreme Court Decision on Trump’s Remain in Mexico Immigration Policy Puts Asylum Seekers in Great Danger

CHICAGO, March 11, 2020 – The Supreme Court of the United States announced today its decision to allow the Trump administration to continue enforcing its Migrant Protection Protocol (MPP) policy, also known as “Remain in Mexico” while litigation that challenges its constitutionality and legality is resolved. With this decision, the court  reverses a ruling by a Federal Appeals Court in California ordering the suspension of MPP in that state and in Arizona this week. Helena Olea, human rights advisor at Alianza Americas, had the following statement with respect to the court decision:

“The Supreme Court decision announced today leaves more than 60 thousand asylum seekers affected by the Remain in Mexico policy in total vulnerability, trapped in one of the most dangerous regions in the world.

The Remain in Mexico policy leaves thousands of people subject to hunger and cold, and puts their health at risk, just as the World Health Organization has declared novel Coronavirus (COVID-19) a pandemic.

That these events are taking place across the border does not erase the direct responsibility of the United States for this inhumane policy that was put into practice more than a year ago, and that is in violation of the human rights of people seeking asylum.

This decision gives the Trump Administration free reign to continue to cut off the right to asylum, a policy it has pursued relentlessly.  Thousands of people will be condemned to wait for an asylum process with little chance of success, under inhumane conditions, and at great risk.”
